By accessing https://privileges.jade.hsbc.com (the "Site") and the offers referenced on the Site (the "Jade Privileges"), you confirm that: a) you are an HSBC Jade client or you are authorised by an HSBC Jade client to act on their behalf; and b) you have read and accept the following terms and conditions as may be amended from time to time including our privacy policy and cookie policy:

In these Terms and Conditions:

  • references to 'you', 'your' and 'yours' are references to the person(s) accessing the Site;
  • references to 'we', 'us', 'our', 'ours' 'ourselves', “the Bank” or “HSBC” are references to the HSBC Group entity with which you have an HSBC Jade status bank account (see appendix);
  • references to the 'HSBC Group' are references to HSBC Holdings plc, its subsidiaries and affiliated companies; and
  • references to 'Programme Participants' are to third party providers of a discount, upgrade or other offer to HSBC Jade clients.

 

Operations of the HSBC Jade Privileges Programme

HSBC Jade Privileges introduces HSBC Jade clients to Programme Participants who may be prepared to make offers and discounts available to HSBC Jade clients.

All offers detailed on this Site are provided by Programme Participants and subject to their terms and conditions. If you have any queries regarding any of the offers, please contact the relevant Programme Participant who is providing the offer.

This Site is operated by us to promote third party offers. Country or region-specific terms may apply to the offers from time to time available in different countries.

 

Eligibility to Participate in the HSBC Jade Privileges

Please see the specific eligibility criteria of each Programme Participant’s offer.

Programme Participants will make offers available through Jade Privileges to HSBC Jade clients. Each HSBC Jade client will need to enter his/her HSBC Jade ID in the Site landing page to establish eligibility for Jade Privileges.

HSBC may terminate your use of Jade Privileges immediately without notice and for any reason (unless otherwise required by relevant regulatory bodies/agencies/court order in which event we will comply with relevant legal, regulatory or judicial requirement), including if you:

  1. do not comply with the Terms and Conditions;
  2. cease to be an HSBC Jade client; or
  3. abuse any privilege offered to you under Jade Privileges.

 

Benefits Under the Jade Privileges

The offers and discounts are listed on the Site and may also be listed in general advertising material from time to time.

 

The offers promoted on the Site (including offer periods or other terms and conditions) may be changed or withdrawn at any time without prior notice either by HSBC or by the Programme Participant.

 

All offers and discounts are subject to availability and other terms and conditions imposed by the Programme Participants.

 

Unless otherwise stated, no offer or discount may be used in conjunction with any other offers, discounts, promotional offers or programmes, discounted items, shopping and dining coupons, membership benefits, fixed-price items, privilege card(s), loyalty programmes, or in-house offers. The offers, and any rights they confer, cannot be sold, transferred, assigned, exchanged for cash, other products or discounts or otherwise dealt with except in accordance with the applicable terms and conditions.

 

To claim an offer you must follow any specific instructions of the Program Participant or other third party as detailed on the Site or as subsequently notified to you by the Programme Participant. Limitations and conditions may apply in relation to offers and availability of such offers during public holidays, festivities or other dates as specified by the respective Programme Participants. Please check with respective Programme Participants for details.

 

If a dispute arises with respect to an offer available through the Site, you should contact the Programme Participant directly to resolve that dispute. We will not be responsible for the failure of any Programme Participant, however, we will make reasonable efforts to assist you in the resolution of a dispute, should you be unable to resolve the dispute directly with the Programme Participant. Disputes with Program Participants will be subject to their applicable terms and conditions and we give no assurance that a dispute will be resolved in your favour.

 

Liability

We have taken and will take all reasonable care to ensure that information we published on the Site is accurate, but neither we nor any other HSBC Group member accepts any liability relating to information provided by Program Participants. Neither we nor any other HSBC Group member makes any representations on behalf of any Program Participants.

All descriptions of offers published on the Site are based on information supplied by Programme Participants. All information is accurate at the time of publication but may be subject to change subsequently. Other special terms and conditions relating to the offers may also apply. For details, please refer to the individual offer and promotion.

Neither we nor any other HSBC Group member shall be responsible for:

  1. any benefit you receive under Jade Privileges;
  2. to the extent permitted by law, any death or injury or consequential loss or damage from a benefit;
  3. representations made by a Programme Participant in respect of any offer; or
  4. any loss, theft or destruction of a benefit or a voucher.

 

Neither we nor any other HSBC Group member shall be liable for:

  1. any unauthorised use of Jade Privileges;
  2. any failure by you to notify a Programme Participant that a transaction is eligible for a benefit under Jade Privileges;
  3. any offer or discount not being available from a Programme Participant for any reason;
  4. any failure by a Programme Participant to meet the terms and conditions on which it has agreed to provide an offer or discount;
  5. any change in the Terms and Conditions, the terms and conditions of a Programme Participant, the Programme Participant or qualifying goods and services;
  6. any change or withdrawal of any offer or discount promoted on the Site or any failure to notify you of any such change or withdrawal;
  7. the suspension and/or termination of the Site or Jade Privileges; or
  8. any malfunction in the operation of your HSBC Jade ID or unauthorized use of your HSBC Jade ID.

 

The Programme Participants do not have any authority, express or implied, to make any representations, warranties or statements on behalf of any HSBC Group member. All contractual obligations relating to Jade Privileges are between you and the Programme Participant.

Any tax which is payable arising from your participation in Jade Privileges is your responsibility, including any goods and services tax.

The Terms and Conditions are governed by the law of the jurisdiction where you have a HSBC Jade status bank account.

In case of discrepancies between the English and other language versions, the English version shall apply and prevail.
